3.4 Sensitive Personal Information

Whitmor does not intentionally collect “sensitive personal information” or “sensitive data” (such as government identifiers, precise geolocation, racial or ethnic origin, health information, or financial account details) through the Website, and we do not use any such information for purposes that would require an opt-in or a right-to-limit option under applicable law. Please do not submit sensitive information to us through the Website.

4. How We Use Your Information

We use the information we collect for the following purposes:

  • Provide and improve our services — respond to inquiries, process customer-service requests, fulfill product-information requests, and improve the Website’s content and functionality.
  • Communications — send newsletters or promotional messages you have opted into; send transactional or service-related messages (for example, replies to your inquiries).
  • Website operations — maintain site performance, troubleshoot technical issues, and protect against fraud, abuse, and security threats.
  • Website analytics — review aggregate, non-identifying information (such as web-server logs) to understand general traffic patterns. We do not currently use third-party website analytics services such as Google Analytics; if we add them, we will update this Privacy Policy and our cookie disclosures (see Section 7).
  • Legal compliance — comply with applicable laws, regulations, legal processes, and enforceable governmental requests, and enforce our terms and policies.

If you are located in the European Economic Area or the United Kingdom, we process your personal data under the following legal bases:

  • Consent — for marketing emails and non-essential cookies. You can withdraw consent at any time.
  • Legitimate interest — for operating and securing the Website, answering your inquiries, and understanding aggregate usage patterns, where those interests are not overridden by your data-protection rights.
  • Legal obligation — where we are required to retain or disclose data under applicable law.

6. Who We Share Information With

We do not sell your personal information, and we do not share it for cross-context behavioral advertising or targeted advertising. We share personal information only with the categories of recipients listed below, and only to the extent necessary for the stated purposes. • In connection with a merger, acquisition, financing, asset sale, or other corporate transaction or reorganization, in which case the successor entity will be bound by this Privacy Policy with respect to any personal information transferred.

7. Cookies & Tracking Technologies

Our Website uses cookies — small text files stored on your device — to operate and improve the site. We use CookieYes to present a consent banner and to manage your cookie preferences.

7.1 Cookie Categories

Category Purpose Consent Required?
Strictly necessary Session management, security, and storing your cookie-consent state No (essential for the site to function)
Functional Remembering preferences such as language or region Yes
Analytics / performance Not currently in use; this Privacy Policy will be updated if added Yes
Marketing / advertising Not currently in use; this Privacy Policy will be updated if added Yes

You can change or withdraw your cookie preferences at any time by using the cookie-settings link in the Website footer or by adjusting your browser settings. Disabling certain cookies may limit Website functionality.

7.2 Do Not Track and Opt-Out Preference Signals

Some browsers and extensions transmit a “Do Not Track” (DNT) signal or a recognized opt-out preference signal such as Global Privacy Control (GPC). There is no industry-standard response to DNT signals, and we do not currently respond to them. Because Whitmor does not sell personal information or share it for targeted advertising, there is no such activity to opt out of; however, where applicable law requires us to honor a recognized opt-out preference signal, we will treat it as a valid request to the extent it applies. We will update this section if our practices change.

8. Your Choices & Marketing Communications

  • Email marketing — We send marketing or newsletter emails only to people who have opted in. You can unsubscribe at any time by using the “unsubscribe” link in any marketing email, or by contacting us at privacy@whitmor.com. We process opt-out requests promptly. Even after you opt out of marketing email, you may still receive transactional or service-related messages, such as a reply to a customer-service inquiry.
  • Cookies — You can manage non-essential cookies through the CookieYes consent banner or your browser settings (see Section 7).
  • Privacy rights requests — Depending on where you live, you may have additional rights and choices described in Sections 12 and 13.

9. Data Retention

  • Contact-form submissions and customer-service correspondence: retained for as long as necessary to resolve your inquiry, plus up to 3 years for quality-assurance and dispute-resolution purposes, unless a longer period is required by law.
  • Newsletter subscriber data: retained until you unsubscribe or request deletion.
  • Web-server logs: retained for up to 12 months for security and operational purposes.
  • Cookie data: retention periods vary by cookie; see the CookieYes consent banner for per-cookie details.

When personal information is no longer needed for any of the purposes above, we will delete or anonymize it in accordance with our data-retention practices, unless a longer retention period is required or permitted by law.

10. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect. These include encryption in transit (TLS/HTTPS), access controls, and periodic security reviews. No method of Internet transmission or electronic storage is completely secure, however, and we cannot guarantee absolute security. If you have security concerns, please contact us at privacy@whitmor.com.

11. Children’s Privacy

Our Website is not directed to children, and we do not knowingly collect personal information from children under the age of 16 (or under 13 in jurisdictions where 13 is the applicable threshold), consistent with the Children’s Online Privacy Protection Act (COPPA) and other applicable law. If you believe we have inadvertently collected personal information from a child, please contact us at privacy@whitmor.com and we will promptly delete it.

12. Your Privacy Rights — U.S. State Laws

Depending on your state of residence, you may have specific rights under a comprehensive state consumer privacy law. As of the effective date of this Privacy Policy, the following twenty states have a comprehensive consumer privacy law in effect: California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia. Additional states have enacted privacy laws that take effect in the future. We will honor the rights described below for residents of any state whose law grants them, whether or not that state is named here.

Subject to applicable law and verification, you may have some or all of the following rights:

  • Right to Know / Access — request that we disclose the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of recipients.
  • Right to Delete — request deletion of personal information we have collected from you, subject to legal exceptions.
  • Right to Correct — request correction of inaccurate personal information we maintain about you.
  • Right to Data Portability — obtain a copy of certain personal information in a portable, readily usable format.
  • Right to Opt Out — opt out of the sale of personal information, processing for targeted advertising, and certain profiling. Whitmor does not sell personal information, does not process personal information for targeted advertising, and does not engage in profiling that produces legal or similarly significant effects.
  • Right to Limit Use of Sensitive Personal Information — where applicable, direct us to limit the use of sensitive personal information. As described in Section 3.4, Whitmor does not collect sensitive personal information through the Website.
  • Right to Non-Discrimination — we will not discriminate or retaliate against you for exercising your privacy rights.
  • Right to Appeal — if we deny your request, you may appeal by contacting us at the address in Section 16. If your appeal is denied, you may contact your state attorney general.

To exercise any of these rights, please email privacy@whitmor.com or write to us at the postal address in Section 16. We will take reasonable steps to verify your identity before processing your request and will respond within the timeframe required by applicable law (generally 45 days, extendable once by an additional 45 days with notice; for some laws, 90 days).

12.1 California-Specific Disclosures

In the preceding 12 months, we have collected the following categories of personal information, as defined by the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA): identifiers (such as name, email address, and IP address); internet or other electronic network activity information (such as browsing activity on our Website and interactions with our emails); and inferences drawn from the above. We have not sold personal information and have not shared personal information for cross-context behavioral advertising. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

California residents may also have the right, under California Civil Code Section 1798.83 (the “Shine the Light” law), to request information about disclosures of personal information to third parties for those third parties’ direct marketing purposes. Whitmor does not disclose personal information to third parties for their own direct marketing purposes.

Authorized agents may submit requests on a consumer’s behalf with written authorization; we may require verification of both the agent’s authority and the consumer’s identity. For questions about our practices relating to California residents, you may contact us as described in Section 16.

13. Your Privacy Rights — GDPR / UK GDPR

If you are located in the European Economic Area or the United Kingdom, you have the following rights under the General Data Protection Regulation (GDPR) and the UK GDPR:

  • Access — obtain a copy of the personal data we hold about you.
  • Rectification — correct inaccurate or incomplete personal data.
  • Erasure (“right to be forgotten”) — request deletion of your personal data under certain conditions.
  • Restriction of processing — ask us to limit how we process your data in certain circumstances.
  • Data portability — receive your personal data in a structured, commonly used, machine-readable format.
  • Objection — object to processing based on our legitimate interests, and to processing for direct-marketing purposes.
  • Withdraw consent — withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing before withdrawal.

To exercise any of these rights, please contact privacy@whitmor.com. We will respond within one month, which may be extended by up to two further months for complex or numerous requests, with notice. If you are not satisfied with our response, you have the right to lodge a complaint with your local data-protection authority.

14. International Data Transfers

Whitmor is based in the United States. If you access our Website from outside the United States, your information may be transferred to, stored, and processed in the United States or in other countries where we or our service providers operate. These countries may have data-protection laws that differ from those in your jurisdiction. Where required by applicable law, we rely on appropriate safeguards — such as the European Commission’s Standard Contractual Clauses and the UK International Data Transfer Addendum — to lawfully transfer personal data. By using the Website, you acknowledge that your information may be transferred as described in this section.

15. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will revise the “Last updated” date at the top of this page and, where required by law, provide additional notice (such as a banner on the Website or an email to subscribers). We encourage you to review this page periodically. Your continued use of the Website after any changes take effect constitutes acceptance of the updated Privacy Policy.
